General terms and conditions of the sale of goods offered through the electronic marketplace Bloombeauty.uz
These General Terms and Conditions have been developed in accordance with the applicable legislation of the Republic of Uzbekistan, including the Civil Code of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “On Electronic Commerce”, the Law of the Republic of Uzbekistan “On Consumer Protection”, and other regulatory legal acts.
These General Terms and Conditions constitute an official offer of LLC “BLOOMSHOP” (hereinafter referred to as the “Agent/BLOOMBEAUTY.UZ”) addressed to individuals for the conclusion of a sale and purchase agreement for goods through the electronic marketplace available online at www.bloombeauty.uz.
The Agreement shall be deemed concluded when the Buyer accepts these General Terms and Conditions (the Offer) in accordance with Article 360 of the Civil Code of the Republic of Uzbekistan, without any additions, exclusions, or reservations. An Agreement concluded on the basis of these General Terms and Conditions shall be valid in electronic form and does not require mandatory execution in paper form pursuant to the legislation of the Republic of Uzbekistan on electronic commerce.
By submitting their personal information on the Website, the User accepts this public offer in the form of the Privacy Policy and User Agreement.
Data protection
The administration of www.bloombeauty.uz (hereinafter referred to as the “Website”) shall not disclose or transfer information provided by the User during registration or use of the Website's functions to third parties, except where such disclosure or transfer is required or permitted by the applicable legislation of the Republic of Uzbekistan.
Collection of personal information
For the purposes of analyzing the activities of LLC “BLOOMSHOP” on the Website, the User may be required to provide certain personal information. The Website reserves the right to request identity verification online or offline.
Use of personal information
The Website uses the User's personal information to provide services and improve the quality of services offered. Certain personal data may be transferred to a bank or payment system where necessary to process payments.
The Website takes all reasonable measures to protect the confidentiality of the User's personal data and discloses such data to third parties only in cases provided for by the legislation of the Republic of Uzbekistan.
Communication
After submitting their personal information, the User receives a message confirming successful registration. The User has the right to stop receiving newsletters at any time by using the relevant service available on the Website.
Security
The Website takes measures to protect the User's account from unauthorized access.
Notification of changes
The Website reserves the right to make changes to the Privacy Policy without additional notice. New versions shall enter into force upon publication on the Website. The User is responsible for independently monitoring changes to the Privacy Policy.
User agreement
General provisions
This User Agreement (hereinafter referred to as the “Agreement”) applies to the BLOOMBEAUTY.UZ Website, available at www.bloombeauty.uz, which is owned by LLC “BLOOMSHOP”.
This Agreement governs the relationship between the Website Administration and the User. The Website Administration reserves the right to amend, add, or remove provisions of this Agreement without prior notice.
Continued use of the Website constitutes the User's acceptance of all amendments. The User is personally responsible for regularly reviewing the Agreement for any changes.
Definitions
For the purposes of this Agreement, the following terms shall have the meanings set forth below:
BLOOMBEAUTY.UZ — a website owned by the Agent and available at the domain www.bloombeauty.uz, through which goods may be selected, ordered, and purchased.
Agent — LLC “BLOOMSHOP”, the owner and operator of the electronic marketplace.
Website Administration — authorized employees of LLC “BLOOMSHOP” responsible for managing the Website.
User — a person who accesses the Website via the Internet and uses it to purchase goods.
Seller — a party to these General Terms and Conditions offering its own goods or goods sold through the Agent's marketplace.
Website Content — protected intellectual property, including texts, graphic elements, design, structure, and other objects comprising the Website.
Copyright protection
The right to use the BLOOM trademark, registered with the Agency for Intellectual Property under Certificate No. MGU 45486-44557 dated 21 February 2025, belongs to LLC “Bloomshop”.
Any use of the Website materials is permitted only with the prior written consent of the copyright holder. Copyright infringement shall result in liability in accordance with the legislation of the Republic of Uzbekistan.
Subject of the agreement
The subject of this Agreement is to provide the User with access to goods and services displayed on the Website, as well as to conclude a sale and purchase agreement between the Seller and the Buyer under the terms set forth in this Offer.
Relations between the User, Seller, and Agent shall be governed by the Civil Code of the Republic of Uzbekistan, the Law “On Electronic Commerce”, the Law “On Consumer Protection”, and other applicable regulatory legal acts of the Republic of Uzbekistan.
Access to the Website is provided free of charge. This Agreement constitutes a public offer, and access to the Website constitutes the User's acceptance of this Agreement.
Rights and obligations of the parties
The Website Administration has the right to:
Amend the rules for using the Website and the content of the Website. Such amendments shall enter into force upon publication of the new version of the Agreement on the Website.
Restrict access to the Website in the event of a User's violation of the terms of this Agreement.
The User has the right to:
Access and use the Website after completing registration.
Use all services offered on the Website and purchase goods presented on the Website.
Ask questions regarding the Website's services using the contact details provided on the Website pages.
Use the Website solely for the purposes provided for by this Agreement and in compliance with the legislation of the Republic of Uzbekistan.
The User shall:
Provide accurate and complete information during registration and when placing an order.
Respect the property and non-property rights of authors and other rights holders.
Refrain from taking actions that may interfere with the normal functioning of the Website.
Refrain from distributing confidential information concerning individuals or legal entities protected under the legislation of the Republic of Uzbekistan.
Refrain from using the Website to distribute advertising without the consent of the Website Administration.
Refrain from taking any actions that violate the legislation of the Republic of Uzbekistan.
Use of the website
The Website and its content belong to the Administration (Agent). Any copying, distribution, or reproduction of Website materials is permitted only with the prior written consent of the Administration.
Purchasing goods offered on the Website may require the creation of a User account. The User is responsible for maintaining the confidentiality of their account information, including their password, and must immediately notify the Administration of any unauthorized access or other security breaches.
The Administration has the right to unilaterally cancel a User account if it has not been used for more than 12 consecutive calendar months, without prior notice.
This Agreement applies to all additional provisions and conditions relating to the purchase of goods and provision of services offered on the Website.
Liability
Any losses incurred by the User as a result of an intentional or negligent violation of the terms of this Agreement, as well as as a result of unauthorized access to another User's information, shall not be subject to compensation by the Website Administration.
The Website Administration shall not be liable for:
Delays or failures in transactions caused by force majeure circumstances or technical malfunctions in telecommunications, computer, or electrical systems.
Actions of payment systems, banks, telecommunications operators, and other third parties.
Proper functioning of the Website where the User does not have the necessary technical equipment or resources.
Violation of the user agreement
The Website Administration has the right to disclose any information collected about the User if such disclosure is necessary to investigate violations, protect the rights of the Administration or other Users, or comply with the requirements of the applicable legislation of the Republic of Uzbekistan.
The Administration reserves the right, without prior notice, to terminate or block the User's access to the Website in the event of a violation of this Agreement.
Dispute resolution
All disputes arising in connection with the conclusion and performance of a sale and purchase agreement for goods shall first be resolved through a pre-trial procedure by submitting written claims. Claims shall be reviewed within 15 (fifteen) calendar days from the date of receipt.
If the dispute cannot be resolved through the pre-trial procedure, it shall be referred to the courts in accordance with the applicable legislation of the Republic of Uzbekistan on civil matters, with jurisdiction determined in favor of the Agent (contractual jurisdiction).
Any claim must be filed within 3 (three) days from the date on which the grounds for such claim arise, except for disputes related to copyright protection, for which a different limitation period shall apply.
Additional terms
The Website Administration does not accept counteroffers from Users regarding amendments to this Agreement.
Reviews posted on the Website shall not be considered confidential information and may be used by the Administration without restrictions.
Payment procedure
The User (Consumer) shall pay the full price of the goods included in the order cart, as well as the delivery fee, on the basis of 100% prepayment. The delivery fee shall be determined on a case-by-case basis, taking into account urgency, distance, floor, availability of an elevator, and other relevant conditions.
Payment may be made in cash or by cashless payment, including online payment through payment systems such as PAYME, CLICK, etc., using bank cards and other electronic payment methods. For orders delivered outside Tashkent, payment shall be made online.
Where the Agent is required to refund funds under the section governing returns, the Agent shall transfer the refund to the bank account or card specified by the User within 14 days from the date of return, provided that the User has complied with the applicable return conditions.
Delivery, exchange and return procedure
The Agent shall arrange delivery of the goods to the User through a courier service, including by engaging third parties.
In certain cases, such as promotional campaigns, delivery may be provided free of additional charge, subject to prior notification by the Agent.
The delivery fee shall be calculated based on the delivery conditions, including urgency, distance, floor, availability of an elevator, and the rates established by the Agent or its partners.
Delivery fees shall be paid in accordance with the terms of these General Terms and Conditions.
Goods of proper quality, including perfumery and cosmetic products, hosiery, personal hygiene items (such as toothbrushes, combs, hair clips, hair curlers, and other similar goods), as specified in Appendix No. 1 as amended by Resolution No. 75 of the Cabinet of Ministers of the Republic of Uzbekistan dated 13 February 2003 — Collection of Legislation of the Republic of Uzbekistan, shall not be subject to return or exchange for an identical product.
Gift certificates
The Seller offers gift certificates (hereinafter referred to as the “Certificates”), which entitle their holders to purchase goods in the amount specified on the Certificate.
Terms of use of Certificates:
Certificates may be transferred to third parties.
Certificates may not be exchanged for cash.
A Certificate is valid for the period specified on the Certificate.
If the purchase price exceeds the nominal value of the Certificate, the difference shall be paid by the Buyer.
If the purchase price is lower than the nominal value of the Certificate, the remaining balance shall not be refunded.
The Seller shall not be liable for the loss or unauthorized use of a Certificate after it has been transferred to the Buyer.
Force majeure
In the event of circumstances preventing the performance of obligations under this Agreement, including fire, flood, earthquake, military action, terrorist acts, strikes, changes in legislation, epidemic, pandemic, and other similar circumstances, the Parties shall be released from liability for partial or complete failure to perform their obligations.
The Party affected by force majeure circumstances shall notify the other Party within 5 (five) calendar days from the date of their occurrence and provide supporting documentation.
If the force majeure circumstances continue, either Party may terminate this Agreement by notifying the other Party at least 10 (ten) business days before the intended termination date. In such case, neither Party shall be entitled to claim compensation for losses.
Confidentiality and processing of personal data
By placing an order, the User consents to the processing of their personal data in accordance with the Law of the Republic of Uzbekistan “On Personal Data”. Processing includes collection, recording, systematization, accumulation, storage, clarification (updating and modification), retrieval, use, depersonalization, blocking, deletion, destruction, and transfer of personal data.
Personal data means any information that makes it possible to identify the User, including full name, date of birth, address, contact telephone numbers, email address, and other information.
Personal data shall be processed for the purpose of fulfilling obligations under the Agreement, conducting analytical, statistical, and marketing research, and protecting the User's property interests.
The User has the right to request from the Agent complete information regarding their personal data and to request correction or deletion of such data by submitting an appropriate request.
Consent to the processing of personal data is granted for an indefinite period and may be withdrawn by the User by submitting a written request.
Dispute resolution
All disputes related to the conclusion and performance of the sale and purchase agreement shall be resolved through a pre-trial procedure by submitting written claims. Claims shall be reviewed within 15 (fifteen) calendar days from the date of receipt.
If the dispute cannot be resolved through the pre-trial procedure, it shall be referred to the courts in accordance with the applicable legislation of the Republic of Uzbekistan, to a civil court selected by the Agent (contractual jurisdiction).
Any claim must be filed within 3 (three) days from the date on which the grounds for filing such claim arise, except for disputes related to copyright protection.
Final provisions
In all matters not expressly regulated by these General Terms and Conditions, the Parties shall be guided by the legislation of the Republic of Uzbekistan.
If any provision of these General Terms and Conditions is declared invalid or unlawful, the remaining provisions shall remain in full force and effect.
This Offer constitutes a legally binding document governing the relationship between the Seller, the Agent, and the Buyer.
